Update The emperor arrived in great health aside from some stress ich,he's super active in the drip bucket. Only downside is they use UPS and as with every piece of livestock I gotten shipped through ups the box was beaten up and wet.

They also just released new tanks,you can see them in ultra corals and fish's sponsor thread.

Its up to him what he does at this point,theres a gray area here in my opinion. It did arrive alive but not in the best of shape but hopefully he will take care of you,I think I know who your are dealing with and he is usually good about this type of problem.
